4DWN Project Inc. – Dallas, Texas
These Terms & Conditions (“Terms”) govern your access to and use of the facilities, services, programs, digital platforms, SMS messaging, and events (“Services”) provided by 4DWN Project, inc., a private non-profit, facility located in Dallas, Texas. By entering the premises, creating an account, purchasing a class, participating in events, or interacting with us digitally (including SMS), you agree to these Terms.
1. GENERAL USE OF FACILITY

Assumption of Risk:
Skateboarding and similar activities are inherently dangerous. By using the facility, you acknowledge and voluntarily assume all risks of injury, including serious injury or death. -
Waiver & Release of Liability:
All participants (or their parent/guardian if under 18) must sign a liability waiver before entering. You agree to release and hold harmless the skate park, its owners, staff, volunteers, and partners from any liability associated with injuries, theft, property damage, or accidents occurring on the premises. -
Age Requirements:

Under 18: Must have a waiver signed by a parent/guardian.

Under 12: Must be supervised by a parent/guardian unless participating in an approved class or session.

Protective Gear:
Helmets are mandatory for all riders. Knee pads, elbow pads, and wrist guards are strongly recommended. -
Compliance:
Users must follow all posted rules, staff instructions, safety guidelines, and session schedules. Violations may result in suspension or termination of access without refund.
2. FACILITY RULES & CODE OF CONDUCT

Respect & Behavior:
We are a community-driven space. Harassment, violence, theft, discrimination, vandalism, or unsafe behavior will not be tolerated. -
Substances:
Use of alcohol, tobacco, vaping, or illegal substances is prohibited on the premises. -
Personal Belongings:
The skate park is not responsible for lost, stolen, or damaged personal items. -
Filming & Photography:
We may record or photograph sessions for promotional purposes. By entering the facility, you grant us permission to use your likeness unless you opt out in writing.
4. DIGITAL ACCOUNTS & ONLINE PLATFORM

Accuracy of Information:
You agree to provide accurate, complete, and updated information when creating accounts or booking services. -
Account Security:
You are responsible for maintaining confidentiality of login credentials and for all activity under your account. -
Prohibited Digital Use:
Users may not engage in unauthorized access, data scraping, malware distribution, or any misuse of our digital platforms.
5. SMS/TEXT MESSAGING TERMS (TCPA/CTIA COMPLIANT)
By opting in to receive SMS/text messages from 4DWN Project inc. you agree to the following:

5.2 Opt-In Requirements
You may opt in by:

Completing a digital or paper waiver including consent language,

Or verbally consenting at the front desk (recorded in your account).
5.3 Opt-Out & Help Commands

5.4 Standard Messaging Disclaimer

Message and data rates may apply.

Wireless carriers are not liable for delayed or undelivered messages.
5.5 Data Handling & Privacy

Mobile numbers are used solely for park communications and are never sold to third parties.

You agree to our Privacy Policy regarding the collection and use of personal information.
5.6 TCPA Compliance
We comply with the Telephone Consumer Protection Act (TCPA), CTIA messaging guidelines, and all applicable consumer protection laws. Consent is required for marketing messages and is not a condition of purchase.
6. PRIVACY & DATA USE
We collect limited personal information such as names, emails, birthdates, and phone numbers for customer administration, safety, and communication.
We do not sell or share your personal info with unrelated third parties.

7. HEALTH & SAFETY

Medical Conditions:
You are responsible for ensuring you are medically able to participate. -
Injuries:
Report all injuries immediately to staff. -
Emergency Response:
We may contact emergency services on your behalf if needed.
8. TERMINATION OF ACCESS
We reserve the right to deny entry or terminate customer access for rule violations, unsafe conduct, non-payment, or behavior harmful to the community.
No refunds will be issued for terminated access.
9. GOVERNING LAW
These Terms are governed by the laws of the State of Texas, specifically applicable to Dallas County.
Any disputes shall be resolved through binding arbitration unless otherwise prohibited by law.
10. MODIFICATIONS TO TERMS
We may update these Terms at any time. Continued use of the facility or digital platforms constitutes acceptance of the revised Terms.
